In an earlier post about Key Concepts on Discovery Procedures in Divorce, we mentioned certain mandatory disclosures and the purpose of discovery in the family law case. Discovery procedures, such as affidavits, depositions, requests for admissions, and requests for production of documents and things, are all used to discover evidence that is relevant to the parties’ case.
Today, we’ll focus on Rule 49 of the Arizona Rules of Family Law Procedure (ARFLP). Under Rule 49, the parties have a duty to disclose all financial information and answer questions pertinent to their divorce. That duty to disclose is a continuing duty, so changes must be provided in the form of amendments to the affidavit.

SACRAMENTO – Former California Gov. Arnold Schwarzenegger says he was helping a friend when he commuted the sentence of the son of a political ally.
Schwarzenegger reduced Esteban Nunez’s sentence from 16 years to seven years on the day before he left office in January. Nunez, who is the son of former state Assembly speaker Fabian Nunez, had pleaded guilty in the 2008 stabbing death of a San Diego college student, 22-year-old Luis Santos.
The decision was criticized by prosecutors, fellow Republicans and Santos’ family, and is now the subject of a lawsuit.
Schwarzenegger said in a Newsweek interview published this week that he understands the parents’ anger and critics’ condemnation.

Long Beach’s smoking lounges haven’t been snuffed out, but no new ones will be able to open.
More than a year after the City Council laid out new rules for the lounges, the council is now looking to cap the number that can operate to the existing eight.
The council voted unanimously Tuesday night to support the proposal by 3rd District Councilman Gary DeLong just two days before a moratorium prohibiting any new smoking lounges was to end today. DeLong said this was what the council had intended all along.
“While we did not want to put any business out of business, council wasn’t interested in having growth in this particular area,” DeLong said.

A few things have been happening in the life of baseball’s Hit King, Pete Rose. Born April 14, 1941, in Cincinnati, Ohio, Peter Edward Rose celebrated his 70th birthday yesterday. On April 13, 1963, playing for the Cincinnati Reds, Rose hit a triple off Pittsburgh Pirate’s Bob Friend — the beginning of a brilliant baseball career for the player known as “Charlie Hustle.” That major league career was derailed by Rose’s game betting as both a player and manager of the Reds. He was permanently banned from baseball in 1989. Rose’s gambling addiction has cost him dearly, and he’s still paying.
In 1990, Rose was convicted of filing false income tax returns with the IRS, having failed to disclose income derived primarily from two sources.

Earlier this month, former UFC light heavyweight champ and Mixed Martial Artist fighter Chuck Liddell — “The Iceman” – filed for full custody of his 12-year-old son, Cade. (Liddell also has a daughter, Trista, who’s mother is MMA fighter Casey Noland). Apparently, the lad made it clear to his father that he didn’t want to live in Colorado with his mother, Lori Geyer, any longer. There are allegations that the child was depressed about having to return to his mother’s after parenting time with Dad, had been suffering with a toothache for months, and was required to remove snow and do other physical work under his mother’s care.
Although this celebrity child custody case will be followed closely by fans, we’d like to discuss the underlying custody question that it raises.
