Spitzer sued for defamation

NEW YORK – Former New York Attorney General Eliot Spitzer and Internet magazine Slate are being accused of defamation, according to a lawsuit filed in federal court last week.

Insurance executive William Gilman, in a complaint filed Aug. 19 in the U.S. District Court for the Southern District of New York, says Spitzer wrote an article in Slate “containing false and defamatory statements” about him.

The article, titled “They Still Don’t Get It,” published Aug. 22, 2010, is “patently false,” said Gilman, who worked at Marsh & McLennan Companies Inc. Find more info…

Colorado boy to plead guilty to murdering parents: prosecutor

DENVER, August 26 – A 13-year-old rural Colorado boy accused of murdering his parents and wounding two siblings in a shooting and stabbing rampage will plead guilty in juvenile court to avoid being tried as an adult, a prosecutor said on Friday.

Robert Watson, the district attorney for Kit Carson County, said the boy, 12 at the time of the killings, will plead guilty to the first-degree murder of his parents, Marilyn and Charles Long, and the attempted murder and aggravated assault of his brother and sister.

The bloody attacks in March shocked the 4,400 residents of Burlington, Colorado, a farming community near the Kansas state line.

Watson said at a news conference the plea agreement was “not an easy decision, nor is it one I am entirely happy with,” but that he had limited options under the law.

“Unfortunately the current status of Colorado law forces us to choose between an either unacceptably light juvenile sentence, or an unnecessarily harsh lifetime sentence,” he said.

The boy will likely serve just seven years in a juvenile detention facility.

Police said the boy placed a 911 call to report that three people were shot at his home in Burlington, 165 miles east of Denver.

When police arrived, they found his parents dead from gunshot wounds fired from a .357 magnum.

They also discovered the boy’s nine-year-old brother, Ethan, critically injured from gunshot and knife wounds and his sister Sara, 5, seriously injured from a knife attack.

Both of the children recovered from their wounds, and are living with relatives.

Watson said his decision not to try the boy as an adult went against the wishes of most of the Long family.

“While it was not unanimous, it was clear that a majority of the family believes this case should be tried in adult court,” Watson said.

He said the case was “problematical” because the boy had no criminal record, and was home-schooled so there were no school, medical or psychological records to rely on.

The boy was evaluated by both prosecution and defense mental health professionals, Watson added.

The prosecutor said the case was “practically unheard of” in the annals of criminology.

“It is extraordinarily rare for a child to kill both parents, and also to attack younger siblings in the same event,” Watson said.

The boy is expected to be sentenced on September 28.

Clifford Chance appoints new Tokyo corporate head to replace Kitchin

Clifford Chance (CC) has named Andrew Whan as the firm’s new Tokyo corporate head, following the departure of partner Alan Kitchin.

Corporate finance partner Whan has relocated to Tokyo from Hong Kong to take up the new post.

News of his move comes after legal website RollonFriday reported earlier today (26 August) that Kitchin had left CC at the end of July – little more than a year after joining.

Kitchin joined CC in February 2010 from Ashurst, where he founded the Tokyo office in 1990 – going on to manage the base until 2002. He also headed Ashurst’s Asia practice between 1998 and 2002.

Whan has been a partner at CC since 2006.

Couple suspected of using lottery ticket as a ruse to rob Simi Valley woman

Simi Valley police detectives are searching for a man and a woman suspected of using claims of a winning lottery ticket to rob a 72-year-old woman.

According to the victim, a couple claiming to need help cashing a winning lottery ticket approached the Simi Valley woman in the 1200 block of Sycamore Drive around 1:30 p.m. Friday. Both the victim and the suspects spoke in Spanish, the victim told police.

The victim voluntarily entered the couple’s van, at which time the couple drove to a nearby parking lot and asked the victim for good faith money. In return, the couple said they would turn over their lottery ticket to the woman so she could cash it, the police report said.

When she was unable to produce the money, one of the robbers pulled a handgun on the victim and demanded her jewelry, which she gave them.

Police shoot and kill armed woman in Watertown convenience store

New York State Police and Watertown Police are investigating an officer-involved shooting that left a woman dead in a Watertown convenience store.

Police say Saturday night shortly after 11 P.M. a 50 year-old woman from Dexter, NY entered Stewart’s Convenience Store on Washington St. and pulled out what appeared to be a firearm.

Police say the woman then started making suicidal comments and pointed the gun at two employees. When police arrived, the woman eventually let the two employees go, but authorities say the woman then pointed the gun at police officers.

Police say two Watertown Police Officers and one Jefferson County Sheriff’s Deputy opened fire, with at least one shot striking the woman in the chest. T
